Introduction to Terms and Conditions
Welcome to Philloflowers.com. Before you place an order via the online shop you should read these terms and conditions carefully as they contain important information about the ordering process and your order. Our terms and conditions may be altered from time to time without notification and therefore advise you to regularly review this policy when you visit this site. Our terms and conditions apply to online orders, orders made by telephone, email and directly at our store, our phillo residence and gardening services. By accessing this web site and on all invoicing,  you agree to these terms and conditions. If you do not agree to them, you may not use this website and should leave it immediately. The www.philloflowers.com website is provided solely for your personal use. You may not use this website for any commercial purpose.
References in these Terms and Conditions to “we”, “us” and “Phillo” are to Phillo Limited (company number 4665943), registered office 272 Regents Park Road, London, N3 3HN.

Ordering from us
We have taken care to ensure that the photographic representation, description and specification of each product is accurate.
Orders can be placed via the online checkout process. As part of the online ordering process you will provide us with information including your personal details, details for the recipient and your payment details – these are mandatory. As part of the checkout process you will be able to check your order and correct any errors. Acknowledgement of receipt of your order will be sent via email, detailing the products you have ordered. We may refuse to accept an order where we cannot obtain authorisation for your payment or if there has been a pricing or product description error.

Gift Vouchers
Phillo gift vouchers are available to purchase on line in denominations of £10, £20 and £50. Phillo gift vouchers are redeemable in full or part payment for goods/services sold in our London store and cannot be redeemed via telephone or at our online shop. Phillo gift vouchers are valid for 12 calendar months from purchase. Gift vouchers cannot be replaced if lost, stolen or damaged.

Pricing Policy and Payment Methods
All prices shown on the website are in £ sterling and are inclusive of VAT at 20%, where applicable. Prices may change and offers may be withdrawn at any time. The price you pay is the price displayed on this website in £ sterling at the time we receive your order, apart from the following exception:
If we discover an error in the price of goods you have ordered, we will inform you as soon as possible and give you the option of confirming your order at the correct price, or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund. While we try and ensure prices on our website are accurate, errors may occur.
We accept payment by American Express, Maestro, Mastercard, Visa and Visa Debit.
If you are paying for your goods using a payment card with a foreign currency denominated account, payment will still be taken in £ stering at the conversion rate applied by the relevant payment scheme at the time of processing your order.

As part of the online ordering process you will provide us with details for the recipient that include their full name, address and a contact number. We may contact you if an issue arises due to problems with delivery. If we cannot contact you or the recipient this may cause a delay in delivering your order. If we cannot deliver your order to the recipient we may accept a signature of a person authorised to receive the order such as a relative or co-worker as proof of delivery and fulfillment of the order.
Problems or delays in delivery may arise if you provide us with incorrect personal details, so before placing your order, please ensure you have included the full name, address details, including correct postcode and telephone number of the recipient. You should also provide us with your daytime telephone number or e-mail address so that we can notify you in the event that any delivery problems are encountered. We shall not be liable for late or non delivery of an order, or delivery of an order to an incorrect address if you provide us with the incorrect address. Our flowers are delivered in water and may be left outside the recipients flat within a communal house if we are granted access by a neighbour and we have decided that it is safe to do so.  Special delivery conditions apply to certain locations where a third party is involved such as residences with a concierge desk, hotels, hospitals and offices. In such cases, the signature of the person authorised to receive the order shall be accepted as proof of delivery and completion of the order.
We would normally call the recipient before delivery to arrange a delivery time, however, if we cannot make contact with the recipient,  we will try to deliver the order and a card will be left with contact numbers to ring for re scheduling the delivery or with details of where the flowers have been left with a third party.
Delivery of flowers and plants can only be made to London post codes. Delivery of non-perishable items such as candles can be made to Mainland UK addresses but delivery charges should be confirmed by phone. Non-mainland UK addresses includes The Channel Islands and Northern Ireland.

Product Availability
Seasonal variation in cut flowers and plants or stock availability of our candles means that some of our products are subject to availability. In the event of supply difficulties or unforseen circumstances that are beyond our control, we reserve the right to substitute a product of equal or greater value and quality without notice.

Personal Messages
We shall not be liable for the content of the message that you have supplied to be delivered with your order and therefore ask that messages refrain from containing material that may be being offensive, threatening, distressing or obscene.

Cancellation and Returns Policy
If you wish to cancel or amend your order, you can notify us by telephone on +44 (0)20 7727 4555, preferably 24 hours before the delivery date. If a cancellation is made on the day that your order is due to be delivered, you may be fully charged but offered a voucher or credit note to the full value of the goods.
In the unlikely event that you are not happy with your goods because they are faulty or incorrectly supplied, you have a statutory right to cancel the contract within 7 working days of receipt and return the products for a refund,exchange or a credit note at our discretion, so long as they are undamaged and in their original packaging. This does not affect your statutory rights. Customers who have paid by credit card will have their accounts credited within 7 working days. Refunds will not be made to a third party. Postage or other return costs will be the customer's responsibility and will be reimbursed by us only in the case of damaged, faulty or incorrectly supplied goods.

We shall not be liable for any indirect, or consequential loss of whatever nature, including damage to software or hardware, loss of data, damage for loss of business, loss of profits, or any other indirect or consequential loss arising out of or in connection with your use of the website or customer services (including without limitation, any such loss arising out of or in connection with any order placed on the website, whether or not accepted by us).
You agree to indemnify us and our agents and officers, directors and employees, immediately on demand, against all claims, liability, damages, costs and expenses, including legal fees, arising out of any breach of these Terms and Conditions by you.

Phillo residence and gardening services- whilst we endeavour to provide a flawless service, we must be notified within 24 hours after the time of set up of flowers, plants and decoration in your home or garden. If damage has occured  to your property or funishings during the installation process or if vessels have leaked during the delivery and set up process. We shall not be laible for any damage that has been caused once we have completed delivery and set up and have left the premises. It is up to the client to provide adequate protection for surfaces where vessels or decorations are to be placed. We shall not be liable for damage to surfaces that have been caused by weather conditions such as rain, this includes staining of exterior stonework and furniture from ingredients in our arrangements whether they are flower,or plant based, or man made materials. The client must accept resposibility for items that have been quoted for and delivered for any particular job and take necessary measures to protect surfaces if the installed items are exposed to the elements of the weather.

When you place orders online or by telephone, we collect certain personal and transactional information (eg name, address, email address, credit/debit card details) from you. These details are kept safe on a secure server and then deleted once the ordering process is completed.

Service Access
While we endeavour to ensure that this Website is normally available 24 hours a day, we will not be liable if for any reason this Website is unavailable at any time or for any period.
Access to this Website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond our control. 
We may change, suspend, restrict or terminate access to the website for any reason at any time. We will not be responsible to you for any delay or failure to comply with our obligations under these terms and conditions if the delay or failure arises from any cause beyond our reasonable control.

Data Protection/Privacy
Our policy is to respect the privacy of all customers. We will not monitor, edit or disclose any personal information about you, without your prior permission, unless we are required to do so to conform to legal requirements or comply with legal process.

We shall ensure that we comply with the requirement of all current data protection legislation including, without limitation, the Data Protection Act 1998 (as replaced, modified or re-enacted from time to time). We shall only use personal data received from you for the purpose of fulfilling our obligations under these Terms & Conditions.

Governing Law and Juristiction
These terms and conditions shall be governed by and construed in accordance with English law. We both agree to submit to the non-exclusive jurisdiction of the English courts for all purposes in connection with these terms and conditions and our privacy policy.
